Pensions
When deciding financial issues in a divorce case, the court can take pensions into account.Pensions can be incorporated within a settlement by means of
- offsetting, where a one-off payment out of other assets is made to offset the value of the pension, or
- an attachment order, where the court can order one spouse to pay the other a lump sum or regular maintenance out of his or her pension scheme, or
- a sharing order where the pension rights of a scheme member are diminished and a separate pension right created for the scheme member’s spouse
The court can also require one spouse to nominate the other as the recipient for all or part of any death-in-service benefits.
Pensions require very careful attention in divorce cases because they can be very significant in financial terms and they are extremely complex.
